1. Acceptance of Terms
By accessing or using the DIGOI Garage Management platform ("DIGOI", "Service", "Platform"), operated by Raditon Intelligence Pvt Ltd ("Company", "we", "us", "our"), you ("User", "Customer", "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
These Terms apply to all visitors, registered users, and anyone who accesses or uses the Service.
2. Description of Service
DIGOI is a cloud-based Garage and Workshop Management Software platform designed for automobile service centers, garages, and workshop businesses in India. The platform provides features including but not limited to:
- Digital Job Card Management
- GST-compliant Billing and Invoicing
- Appointment and Scheduling Management
- Spare Parts Inventory Tracking
- Real-time Analytics and Reporting
- Multi-user Role Management
- Customer Relationship Management
3. Account Registration
To access DIGOI's features, you must register for an account by providing accurate, complete, and up-to-date information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorised access at info@voius.in.
We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.
4. Subscription and Payment
DIGOI may offer free trial periods and paid subscription plans. The following terms apply to paid plans:
- Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout.
- All prices are inclusive of applicable GST unless stated otherwise.
- Payments are non-refundable except as outlined in our Refund Policy.
- We reserve the right to change pricing with 30 days' advance notice.
- Failure to pay may result in service suspension or termination.
5. Acceptable Use
You agree not to use DIGOI to:
- Violate any applicable Indian or international laws or regulations.
- Upload or transmit malicious code, viruses, or harmful software.
- Attempt to gain unauthorised access to any part of our system or another user's account.
- Use the platform to conduct fraudulent activities or misrepresent your identity or business.
- Scrape, copy, or reproduce any part of the platform without written consent.
- Resell or sublicense access to the platform without prior written agreement.
6. Intellectual Property
All intellectual property rights in DIGOI — including but not limited to software, source code, UI design, logos, trademarks, and content — are owned by Raditon Intelligence Pvt Ltd. These Terms do not grant you any ownership rights in our platform.
You retain full ownership of all business data you upload or create within DIGOI (job cards, customer data, invoices, etc.). By using the platform, you grant us a limited licence to process this data solely to provide the Service.
7. Data and Privacy
Your use of DIGOI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that any personal data you upload about your customers has been collected in compliance with applicable data protection laws.
8. Service Availability
We strive to maintain high uptime for DIGOI but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control, including third-party infrastructure failures, internet outages, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by Indian law, Raditon Intelligence Pvt Ltd shall not be liable for:
- Any indirect, incidental, special, or consequential damages arising from your use of DIGOI.
- Loss of revenue, data, goodwill, or business opportunities.
- Errors or inaccuracies in reports or analytics generated by the platform.
Our total cumulative liability for any claim under these Terms shall not exceed the amount you paid for the Service in the three months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Raditon Intelligence Pvt Ltd, its directors, employees, and agents from and against any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of DIGOI, (b) your violation of these Terms, or (c) your violation of any third-party rights.
11. Termination
Either party may terminate the service agreement at any time. You may cancel your subscription through your account settings or by contacting us. We reserve the right to terminate or suspend your access without notice if you breach these Terms. Upon termination, your right to use DIGOI ceases immediately, and data deletion timelines specified in our Privacy Policy will apply.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English in India. The courts of India shall have exclusive jurisdiction over any unresolved matters.
13. Modifications to Terms
We may revise these Terms at any time. We will notify you of material changes via email or a notice on the platform at least 7 days in advance. Continued use of DIGOI after the effective date constitutes acceptance of the revised Terms.
